Information concerning the handling of personal data

PRIVACY POLICY

Mak S.p.A. whose registered office is in Carpenedolo (BS), via C. Colombo 14 - 25013, VAT no. 01840560989 (hereinafter, "Controller"), Controller of the Website www.mate-tech.it (hereinafter, the "Website"), as controller of the processing of personal data of Users who surf and are registered on the Website (hereinafter, the "Users") hereinafter provides for the privacy policy pursuant to art. 13 of EU Regulation 2016/679 dating back to April 27, 2016 (hereinafter, "Regulation" or "Applicable Law").

The Website and any services offered through the Website are reserved for persons of age or older. The Controller therefore does not collect personal data relating to persons under the age of 18. At the request of the Users, the Controller will promptly delete all personal data involuntarily collected and relating to persons under the age of 18.

The Controller takes the utmost account of the right to privacy and protection of personal data of its Users. For any information in relation to this privacy policy, the Users may contact the Controller at any time, using the methods described in paragraph 4.
 

1. Processing goals

The personal data of the Users will be lawfully processed by the Controller pursuant to art. 6 of the Regulations for the following processing purposes:
  1. Surfing of the Website, in relation to the possibility of collecting the User's data necessary at a technical level, such as, for example, the IP address, while browsing the Website.
  2. Reply to the User requests for information, received by the Controller through the appropriate contact form.
  3. Legal obligations, i.e. to fulfil obligations provided for by law, by an authority, by a regulation or by European legislation.
  4. Contractual obligations and provision of services in the case of online purchases, to implement the General Conditions of Sale, which are accepted by the User during the registration on the Website and fulfil specific requests of the User. The User data collected by the Controller for the purposes of any registration on the Website include: Compulsory data: Email, Password, First Name, Last Name, Shipping Address, Cap, City, Province, Country, Optional data: any personal information of the User that may be voluntarily published. The User's personal data will be used by the Controller for the exclusive purpose of ascertaining the User's identity, thus avoiding possible fraud or abuse, and to contact the User for service reasons only (e.g. to send notifications regarding the services offered on the Website). Without prejudice to what is provided elsewhere in this privacy policy, under no circumstances will the Controller make the personal data of the Users accessible to other Users and/or third parties.
  5. Administrative-accounting purposes, i.e. to carry out organisational, administrative, financial and accounting activities, such as internal organisational activities and activities functional to the fulfilment of contractual and pre-contractual obligations.
The provision of personal data for processing as hereinbefore specified is optional but necessary, as failure to provide such data will make it impossible for the User to browse the Website, register onto the Website and profit from the services offered by the Controller on the Website.

With reference to the purposes referred to in points 1/a, 1/b, 1/d, the legal basis of the processing is in fact the execution of services provided through the Website and requested by you (pursuant to Article 6, paragraph 1, letter b of the Privacy Regulation 2016/679); with reference to the purposes referred to in point 1/c and 1/e of the previous paragraph, the legal basis of the processing is to comply with a legal obligation which the Controller of the treatment is subject to (pursuant to Article 6, paragraph 1, letter c of Privacy Regulation 2016/679).
 

2. Processing modes as well as data storage duration

The Data Controller will process the User’s personal data by means of manual and IT tools, with logic strictly related to the purposes themselves and, in any case, in such a way as to guarantee the security and confidentiality of the data itself.
The personal data of the Users of the Website will be kept for the time strictly necessary to carry out the purposes described in paragraph 1 above, or in any case as required for the civil protection of the interests of both Users and the Controller. 
 

3. Data disclosure and spreading

The personal data of the Users may be disclosed to the employees and/or operators of the Controller in charge of managing the Website. These subjects, who are formally appointed by the Data Controller as "data processors", will process the User's data exclusively for the purposes reported in this information notice and in compliance with the provisions of the Applicable Law.

The personal data of Users may also be disclosed to third parties liable for processing personal data on behalf of the Controller as "External Data Processors", such as, for example, providers of IT and logistics services functional to the operation of the Website, outsourcing or cloud computing service providers, professionals and consultants.

The data may also be communicated to the tax authorities and/or other public authorities where required by the law or at their request.

Users have the right to obtain a list of any data processors appointed by the Data Controller, by making a request to the Data Controller according to what specified in paragraph 4 below.
  Users may exercise the rights granted to them by the Applicable Law by contacting the Controller as follows:
  • By sending a registered letter to the registered office of the Controller 
  • By sending an e-mail to privacy@makwheels.it
In accordance with the Applicable Law, the Users may exercise their rights under art. 15 and following of the Regulation, according to what provided for in art. 12 of the Regulation.

If the User considers that any processing breaches the Regulation, the User has the right to lodge a complaint with a supervisory authority (in the Member State in which the User is habitually resident, in the Member State in which the User works or in the Member State where the alleged violation occurred). COOKIE POLICY

In relation to the aforementioned processing, the Controller provides the following information, in addition to the Privacy Policy of the Website.  The various types of cookies and the technologies used on Mak S.p.A. Website are hereinafter described, in the light of the provisions of the Privacy Guarantor of May 2014, "Identification of simplified procedures for the information and acquisition of consent for the use of cookies - May 8, 2014 (Published in the Official Gazette no. 126 of June 3, 2014)" available at http://www.garanteprivacy.it/web/guest/home/docweb/-/docweb-display/docweb/3118884 to describe the configuration methods and conditions of use of the same.
 

WHAT ARE THE COOKIES?

Cookies are small text files that visited Websites send to the navigation device used by the User (usually a browser). They are stored in the corresponding browser folder while the user is intent on visiting a Website, and are then retransmitted to the same Websites on subsequent visits.

They are used to improve surfing, save user preferences already entered (username, password and the like), track the tastes and preferences of the user, allowing to manage targeted marketing initiatives or the provision of services related to the activities of the Controller such as newsletters, service communications on the Website, etc.. If restrictions are placed on their use, these will affect the usability of the contents of the Website during consultation. It is always possible for the User to pre-emptively block or remove them from the browser cache, but such actions may result in incomplete use of the services offered by the web application.
 

TYPES OF COOKIES

Session cookies
They are temporary files, which exist only for the duration of the user's browsing session. When the browser is closed, Session cookies expire.
They are generally used to identify the Users when they access a Website, to remember them and their preferences when switching between the pages of the Website, to provide them with specific information previously collected. 

Persistent cookies
They are files that remain active even after the User closes the browser and  they help the Websites remember the User’s data and user settings for later consultation. This allows for a faster and more time-efficient access since there is no need to log in again.

Technical cookies
Some cookies are essential for the proper functioning of the Website. Without them, the User would not be able to navigate through it and use some of its functions. This type of cookie is "technical", i.e. session or permanent, and they allow to remember, from one page of the booking process to another, the information provided by the user.  Since these cookies are essential, disabling them may compromise the of the Website content or the Website use may be impossible or severely limited.

Profiling cookies
These are cookies that allow to create user profiles in order to send advertising messages in line with the preferences expressed by the User when surfing the website. The use of these cookies requires the consent of the user.

In line with the standard practices of many Websites, the Website www.mate-tech.it may install cookies on the computer used by the User.  By using the Website, the User agrees to the use of the technologies forecast, but the User may also block or delete (in whole or in part) the cookies received.

While browsing the Controller's Website, the User may also receive cookies from third parties, i.e. cookies from third party Websites or servers that are different from those of Mak S.p.A., in particular:

Google Analytics: it is a service offered by Google Inc. generating detailed statistics on Website traffic and traffic sources. It is the most widely used statistics service. Google Analytics can track visitors from all external links to the Website, including search engines and social networks, direct visits and referral Websites. These cookies do not collect information that identifies a User. All data collected and shared with Google Inc. is anonymised (by deleting significant IP address components of both IpV4 and IpV6 types) and is only used to improve the operation of our Website. For regulatory purposes, Analytics cookies of anonymised third parties are treated as technical cookies and do not require information banners, informed consent and notification to the Privacy Guarantor.

DoubleClick: it is a service of the digital advertising platform offered by Google Inc. Technology: this technology enables the creation, transmission and management of digital advertising campaigns for Website managers. The Website profits from some external functions or it implements some external links as to improve the integration with commonly used third party Websites or social media (Facebook, Google and similar sharing keys). Such functions and links could require third party cookies: refer to the single site privacy policy for more information.

The users can oppose the registration of cookies on their device by configuring the browser used for navigation: if they use the Website without changing the settings of the browser, it is assumed that they intend to receive all the cookies used by the Website and enjoy all the features.
